These Terms of Service and End User License Agreement (the “Terms”) govern your access to and use of the Trip Solitaire mobile application and related services, websites, content, features, and digital products (collectively, the “Service”). By downloading, installing, accessing, or using Trip Solitaire, you agree to these Terms. If you do not agree, do not use the Service.

1. ABOUT THE SERVICE

Trip Solitaire is a casual digital card game and travel-themed entertainment experience. The Service may include solitaire gameplay, travel progression, cities, landmarks, stories, collectibles, virtual items, rewards, account features, events, and other features that may be introduced, modified, suspended, or discontinued from time to time.

2. ELIGIBILITY

You must be legally permitted to use the Service in your jurisdiction. If you are under the age required to enter a binding contract in your jurisdiction, you may use the Service only with the involvement and permission of a parent or legal guardian where required by law.

3. LICENSE TO USE THE SERVICE

Subject to your compliance with these Terms, ByteBound grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for personal, non-commercial entertainment purposes on devices that you own or control.

You do not acquire ownership of the Service or any intellectual property merely by downloading, accessing, or purchasing content.

5. ACCOUNTS AND GUEST ACCESS

Trip Solitaire may allow guest play and/or account-based access through supported authentication methods. Options may vary by platform, region, device, and version.

You are responsible for protecting credentials or authentication methods associated with your account. Guest progress may be stored locally or associated with device or service identifiers and may be lost after uninstalling the app, clearing app data, changing devices, or losing access to the relevant account or device. ByteBound does not guarantee recovery of guest progress.

6. GAMEPLAY, PROGRESSION AND VIRTUAL ITEMS

The Service may contain virtual currency, tickets, boosters, cards, collectibles, fragments, experience points, rewards, cosmetic items, and other digital content (“Virtual Items”). Virtual Items have no cash value and are not redeemable for money or goods outside the Service unless required by law.

Virtual Items are licensed, not sold. You may not transfer, sell, trade, sublicense, or exchange them outside the Service.

ByteBound may adjust gameplay parameters, reward values, prices, progression systems, item characteristics, or other mechanics, subject to applicable law and any rights that cannot legally be removed.

7. IN-APP PURCHASES

Optional purchases may be offered through Apple’s App Store, Google Play, or another authorized payment provider. Platform billing, payment, refund, and cancellation rules apply to those transactions.

Prices are displayed before purchase and may vary by country, currency, taxes, platform, and applicable pricing rules. Except where required by law or platform policy, purchases are generally final and non-refundable. Refund requests should normally be submitted through the platform used to make the purchase.

If recurring subscriptions are offered, the applicable purchase screen and platform will disclose price, billing frequency, renewal terms, and cancellation procedures before purchase.

8. APPLE AND GOOGLE PLATFORM TERMS

Your use of Trip Solitaire through Apple’s App Store, Google Play, or another platform is also subject to the applicable platform’s terms and policies.

For the iOS version, Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms and may enforce applicable provisions as a third-party beneficiary. Apple has no obligation to provide maintenance or support for the Service.

For Android versions, Google Play and Google’s applicable terms govern distribution, billing, and certain platform services. Google is not responsible for the content or operation of Trip Solitaire except as required by law or Google policy.

9. INTELLECTUAL PROPERTY

The Service and its software, artwork, characters, animations, stories, text, music, sounds, graphics, logos, trademarks, interfaces, and other materials are owned by or licensed to ByteBound and protected by applicable law. Except for the limited license expressly granted here, no rights are transferred to you.

10. USER FEEDBACK

If you submit suggestions, ideas, bug reports, comments, or other feedback, you grant ByteBound, to the extent permitted by law, a worldwide, royalty-free, perpetual, irrevocable, transferable, sublicensable right to use and incorporate that feedback without compensation.

11. FAIR PLAY AND PROHIBITED CONDUCT

You agree not to exploit bugs, unintended mechanics, vulnerabilities, or technical weaknesses. ByteBound may investigate suspected abuse and take proportionate action, including correcting progression, restricting features, suspending access, or terminating accounts where reasonably necessary.

12. AVAILABILITY AND CHANGES

ByteBound may update, modify, suspend, or discontinue all or part of the Service, including features, content, cities, levels, Virtual Items, or events. The Service may also be temporarily unavailable due to maintenance, updates, technical problems, network conditions, third-party failures, or circumstances beyond reasonable control.

13. DISCLAIMERS

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DO NOT WARRANT THAT IT WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR AVAILABLE AT ALL TIMES, OR THAT ANY PARTICULAR CONTENT, FEATURE, REWARD, OR PROGRESSION WILL REMAIN AVAILABLE.

Nothing in these Terms excludes or limits consumer rights, warranties, or remedies that cannot lawfully be excluded.

14. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BYTEBOUND AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING FROM USE OF THE SERVICE.

Where liability cannot be excluded, it will be limited to the maximum extent permitted by applicable law.

15. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless ByteBound and its affiliates, officers, directors, employees, and agents from claims, losses, liabilities, damages, costs, and expenses arising from your unlawful use of the Service, violation of these Terms, or infringement of another person’s rights.

16. TERMINATION

You may stop using Trip Solitaire at any time. If account deletion is available, you may request it through the in-app method or by contacting whocaredog@icloud.com.

ByteBound may suspend or terminate access where reasonably necessary for security, fraud prevention, legal compliance, serious or repeated violations, or protection of users and the Service. Where required by law, applicable notice and remedies will be provided.

17. PRIVACY

Our collection and use of personal information is governed by the Trip Solitaire Privacy Policy available at https://tripeaks.bytebound.ca/.

18. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of British Columbia, Canada, except where mandatory consumer protection laws provide otherwise. Disputes will be handled by courts or dispute-resolution mechanisms required or permitted by applicable law.

19. CHANGES TO THESE TERMS

We may update these Terms. Material changes will be communicated through reasonable means where required. The Effective Date will be updated. Continued use after the effective date constitutes acceptance to the extent permitted by law.

20. SEVERABILITY AND ENTIRE AGREEMENT

If any provision is invalid or unenforceable, the remaining provisions remain effective to the extent permitted by law. These Terms, the Privacy Policy, and feature-specific terms constitute the agreement concerning the Service.
